How to Get H-1B Visa From India? 

If you wish to apply for a new H-1B visa, consider whether your occupation comes under the speciality occupation list. If your occupation falls under the list, you must register on the USCIS portal. While you may consult an attorney or gazetted officer to manually create your account and register on your behalf , that may become a tedious process.

What are the New regulations for H-1B Visa Electronic Registration?

From 2020 onwards, the US administration has launched new electronic registration norms in line with their current H-1B cap. As per the new regulations, the petition for the H-1B will now be deemed legitimately filed only if the same is done through the valid registration process, i.e. through the USCIS portal.

How to check H-1B visa status?

You can quickly check your H-1B visa status once registered on the USCIS portal by following these steps: 

  • Visit the USCIS portal and select the “Tools” tab from various sections given at the top. 
  • In the next window, you will see various tools as widgets on the webpage. Select the “Case Status Online” tool. 
  • Enter your 13-digit receipt number in the next window and press the “Check Status” button. You will be directed to the next window, where you can see your H-1B visa application status.

The account will show your status as one of the following:

Submitted: You have submitted your registration, which  is valid.

Selected: You can apply for an H-1B visa.

Not Selected: You were not selected to apply for an H-1B visa this time.

Invalidated: The status will show as “invalidated” if you have completed the registration process but didn’t complete your payment process.

Denied: If you have accidentally undergone repeated registration for an H-1B visa with a single employer, the USCIS portal will automatically consider your registrations as “invalid”.

What is the H-1B visa duration and validity?

The H-1B visa is valid for  three years, which can be extended to six years.
